Terms of Service
1. Acceptance of Terms
By downloading, installing, accessing, or using the ScreenProp mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
ScreenProp is developed and operated by Mayking Industries LLC ("we", "us", "our"). These Terms constitute a legal agreement between you and Mayking Industries LLC.
2. Description of Service
ScreenProp is a professional tool designed for film and television production. The App enables production crew members ("Production") to remotely trigger realistic smartphone simulations — including text messages, phone calls, video calls, and notifications — on a separate device used by talent ("Talent") during on-camera filming.
The App requires two or more devices connected via the internet (WiFi or cellular data) and uses Firebase Realtime Database for real-time synchronization.
3. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on compatible mobile devices that you own or control, solely for your personal or professional film production purposes.
You may not:
- Copy, modify, distribute, or create derivative works based on the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Use the App for any unlawful purpose
- Remove or alter any proprietary notices in the App
4. Subscription and Billing
4.1 Pricing
ScreenProp is available as a monthly subscription at $4.99 per month. All features are included — there are no tiers, add-ons, or per-seat charges.
4.2 Billing
Subscriptions are billed through the Apple App Store or Google Play Store, depending on your platform. All billing, payment processing, and refund requests are handled by the respective app store platform.
4.3 Cancellation
You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period. You will retain access to the App for the remainder of your paid period.
4.4 Price Changes
We reserve the right to change subscription pricing. Any price changes will be communicated in advance through the respective app store and will not affect your current billing period.
5. Acceptable Use
You agree to use ScreenProp only for lawful purposes related to film, television, video, or media production. You may not use the App to:
- Impersonate another person for fraudulent purposes
- Create fake evidence or misleading communications
- Harass, threaten, or deceive any individual
- Violate any applicable local, state, national, or international law
- Interfere with or disrupt the App's infrastructure or other users' sessions
- Attempt to gain unauthorized access to other users' sessions
ScreenProp is designed exclusively as a professional production tool. You are solely responsible for ensuring that your use complies with all applicable laws and regulations.
6. User Content
You retain ownership of all content you create or input into the App, including messages, contact names, images, and conversation scripts. We do not claim any intellectual property rights over your content.
You are solely responsible for the content you create and display using the App. Content is temporarily stored in Firebase during active sessions and automatically deleted when sessions end.
7. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to our data practices as described in the Privacy Policy.
8. Intellectual Property
The App, including its design, code, features, and all related intellectual property, is owned by Mayking Industries LLC and is protected by copyright, trademark, and other intellectual property laws.
The ScreenProp name, logo, and associated branding are trademarks of Mayking Industries LLC. You may not use our trademarks without prior written consent.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, error-free, or secure
- The results obtained from the App will be accurate or reliable
- The App will be compatible with all devices or operating systems
- Defects in the App will be corrected
The App simulates smartphone interactions for professional production purposes only. We are not responsible for any consequences arising from the use of simulated content in any context.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAYKING INDUSTRIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless Mayking Industries LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.
12. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including if we believe you have violated these Terms.
Upon termination:
- Your license to use the App is immediately revoked
- You must cease all use of the App
- Active sessions will be terminated and associated data deleted
Sections regarding limitation of liability, indemnification, and governing law survive termination.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted with a new "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
For material changes, we will provide notice through the app store listing or release notes.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mayking Industries LLC regarding your use of ScreenProp and supersede all prior agreements and understandings.
